This applies each time the application is accessed, even if the disclaimer does not appear on each and every occasion that the application is accessed.

Disclaimer 

The Sydney Eyedrop app aims to support your health outcomes as a patient by helping you to take your ophthalmic medications as directed and providing a convenient location to store, access and share relevant health information. This will help you to have easy and meaningful conversations with the people in your care team. 

The drug information contained in this application content is provided by the Sydney Hospital and Sydney Eye Hospital Pharmacopoeia App database. Please refer to the Sydney Hospital and Sydney Eye Hospital Pharmacopoeia App disclaimer regarding this information. 

Your obligations 

If you are operating the App on behalf of someone else, you must have that person’s consent or authority to share their personal information with us. In accepting these terms and conditions you confirm that you have obtained that consent. It is your obligation to take all reasonable steps to ensure that no unauthorised person has access to the App or the personal information contained in it. 

If you are using the app for yourself or on behalf of someone else, it is your responsibility to enter and save the correct drug regime as prescribed by your or the other person’s medical practitioner/practitioners. You may refer to prescription and consultation aids as reference, however it is your responsibility to enter the correct drug information and regime as prescribed and to confirm them with reliable sources. If you have any enquiries regarding the therapy, please consult with the treating practitioners.  The app developer team and Sydney Hospital and Sydney Eye Hospital is not responsible for any drug side effects or drug error including and not limited to transcribing errors, eye medication administration errors or drug misuse and any associated consequences arising from such events. 

License 

The purpose of this Agreement is to allow you to use the App (including any updates). The App means all databases, data, and documentation on the application which may be used by you to manage medicines and other health information to create better health outcomes, for either yourself or those you care for. The App is currently made available to you free of charge and we reserve the right to amend the App, or provide any updates as required at any time and for any reason and without warranty. We will notify you regarding such changes.

Privacy statement

The Sydney Eyedrop App will store and use your information strictly in line with Australian privacy laws, within the app. 
We will never share your identifiable information with third parties without your consent. 
The Sydney Eyedrop App does not collect any identifiable personal information as outlined by the app content. 
 

Internet and data charges

As you know, the App is provided over the internet and mobile phone networks and accordingly the quality, speed, availability and reliability of the App may be affected by factors outside our control when using or downloading the app. You should also be aware that the terms and conditions of use of your mobile network and internet provider continue to apply to you in relation to your use of the App and because of that you may incur charges when using the App.
 

Support and upgrades

We wish to provide you with an App which is easy to use and up to date. When updates are issued, we may require you to install these in order to continue using the App. If you experience any difficulties, we may be able to help. Please email or contact Sydney and Sydney Eye Hospital with your query and we will do our best to help you.
 

Limitation of use

Please be aware that the App is not a substitute for medical advice. Any personalised notifications, information or medical issues should be discussed with a qualified health care professional. If in doubt, please seek medical advice. We do not endorse or recommend any brands, products (including medicines), tests, treatments or procedures mentioned in the App. These are provided for information only. 
 
The Sydney Eyedrop is made available on the understanding that Sydney Hospital & Sydney Eye Hospital including the NSW ministry of Health and Director – General of NSW Health and its employees and agents is not liable (including liability by reason of negligence) to the users of the App for any loss, damage, cost or expense incurred or arising by reason of any person using or relying on the information in the App whether caused by any error, negligent act, omission or misrepresentation or misinterpretation in the information or otherwise. 
 

Termination

You may end this Agreement at any time by deleting the App or simply stop using the App. 
 

General Prohibitions

While we want you to enjoy using the App we also need to protect it. We ask that you only use the App for the purpose for which it is provided and for no other purpose.
Please be aware that the App is also protected by copyright and other intellectual property laws. This means that while you are licensed to use it, this use does not transfer any right, title, or interest in the App. We retain these rights, including rights in any modifications or improvements to the App, regardless of who makes them.
 

General

This Agreement constitutes the entire agreement between the parties. This Agreement is personal to you and may not be assigned to anyone else.
